Illegal Interview Questions

Many people don't know what illegal interview questions are. You have rights and there are limits to what can be asked during an interview.

Employers cannot discriminate against individuals in protected classes.  To do so is illegal.  Candidates in the hiring processes have many rights.

Questions relating to these protected classes cannot be asked of candidates:

Illegal Interview Questions

Employers should not ask about any of the following, because to not hire a candidate because of any one of them is discriminatory:

  • Race
  • Color
  • Sexual preference
  • Gender
  • Religion
  • National origin
  • Birthplace
  • Age
  • Disability
  • Marital/family status

Some interviewees actually volunteer information that would be considered illegal to acquire through the interview process. Inexperienced candidates might do this when asked the ice-breaker question, "Tell me about yourself." They may start by saying "Well, I'm a single mother, with 2 children. I'm 41-years old, go to church on Sunday and love steak and kidney pie." Having said that, there's not much more the interviewer can ask that's considered illegal, you've said a lot already.
